Learning Outcomes: Students will become familiar with how auto liability claims differ from other types of auto insurance by examining driving laws, liquor liability laws, and tort law. Personal auto policies will be explored, as well as commercial auto policies and auto dealers and motor carrier coverage forms. Medical payments, uninsured motorists and personal injury protection will also be discussed. Students will learn to apply auto policy definitions and exclusions to auto claims, and to determine whether the PAP covers an insured’s family member, whether a policy covers an auto rental, whether multiple coverages overlap, and how claim denials should be documented. Students will learn to analyze partial and total losses in regard to auto insurance coverage, as well as how to evaluate repair estimates and damage appraisals, and why courts may accept or reject diminished auto value claims. Students will learn how to create a bodily injury claims investigation plan, as well as how to evaluate medical treatment, physical impairment, and psychological injury associated with a bodily injury claim. Students will examine the key factors that determine the value of a claim, and the elements and methods of calculating a liability claim settlement. Students will become familiar with the process of preparing settlements and releases and the tactics used to do so, and investigating subrogation.
